Prior to 2013, the Second Injury Fund was running out of money. On July 10, 2013, Governor Jay Nixon signed into law legislation designed to fix Missouri’s second-injury fund. Caps put in place in 2005 on the surcharge from the Second Injury Fund left the fund insolvent. Increased surcharges began in early 2014 and allow the fund to regain solvency in the near future, clearing the way for new claims against the Second Injury Fund.
